Your eligibility for Services is subject to approval by Credit Cache and/or its major online state-licensed lending partners, marketplace lenders, tribal lenders, and other non-lender parties who have partnered with us, such as marketing partners and third party finders and aggregators working on behalf of lenders (Partners).

When you submit our online form, you are certifying that all the information you have provided in your online form is true, accurate, and complete. Our Partners may use specific criteria and/or filters to identity if they would like to connect with you. If your details match with one of our Partners, you will receive various loan offers from them to review. Partners may also specify the commission or referral fees they will pay us for the opportunity to present an offer to you that meets their criteria.

If you find a loan that suits your needs and financial objectives and you want to proceed, we will introduce you to that Partner by transmitting your information via our integrated technology. The Partner will provide you with a conditional loan offer (consisting of the terms and conditions of the loan). Please read the terms of any loan offered by any of our Partners to ensure your needs and financial objectives meet the loan terms and conditions. If you agree to the terms, the Partner will fund your loan and you will get cash into your bank account (please note that the amount of time to transfer funds may vary between lenders and may also depend on your individual financial institution).

If your details do not match with any of our Partners, we may present you with an offer to submit another loan request or an offer for a different product. We also may share your contact information with third-party marketers and service providers that may contact you by email or text message/SMS to offer you loans or other products that may be of interest to you.

We may also allow you to request products or services other than loans that are advertised on the Site based on your interest. The amount of any loan offer, if one is made, will vary depending on the Partner, your creditworthiness and your state’s laws.

Please note tribal lenders may claim exemptions from state licensing and usury caps (based on tribal immunity or bank pre-emption), the rates and fees offered by tribal lenders may be higher than those offered by our major online state-licensed lending partners and tribal lenders may require you to agree to resolve any disputes in a tribal jurisdiction.

You acknowledge and agree that Credit Cache, its Marketing Providers and its Partners, and each of their affiliated companies, and their respective directors, officers, employees, agents, representatives, partners, contractors, successors and assigns, will not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including, without limitation, damages for loss of profits, use, loss of data, loss of security arising out of or in any way connected to your use of this Site, or of information or materials available through the Site, whether based in contract, tort, strict liability, or otherwise.

Credit Cache reserves the right to assume or participate, at your expense, in the investigation, settlement and defense of any such action or claim.

Any failure by Credit Cache to exercise any rights or enforce any of these Terms shall not constitute a waiver of such rights or terms with regard to the use of the Site. If any provision of these Terms or their application in a particular circumstance is held to be invalid or unenforceable to any extent, the remainder of these Terms, or the application of such provision in other circumstances, shall not be affected, and each provision shall be valid and enforced to the fullest extent permitted by law. The laws of the United States and the State of California, excluding California’s conflict of laws rules, will apply to any disputes arising out of or relating to these Terms or the Site. All claims arising out of or relating to these Terms or the Site will be litigated exclusively in the federal or state courts of Los Angeles, California U.S.A., and you and Credit Cache consent to personal jurisdiction in those courts. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or relating to your use of this Site, the Services or the Content must be filed within one year after such claim or cause of action arose or be forever barred.

Credit Cache reserves the right at its sole discretion, to update, change, modify, add or remove portions of these Terms, at any time. It is your responsibility to check these Terms periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes.
